Property Damage: We have litigated and/or tried, hundreds of property damages cases. These types of cases generally fall into two categories, first party (when an insured is suing their own insurance carrier) and third party (when someone sues the tort feasor (or negligent party) suits. Of course, the importance of having well skilled aggressive attorneys that move cases towards resolution are important in all areas of litigation, but even more so in the first party suits.

Because in first party suits the insured’s attorney is entitled to fees by the hour, and the amount to be billed by the hour is solely up to the Court. Thus, attorneys representing first party Plaintiff’s have an incentive to be extremely litigious. Add to this the possibility of a bad faith suit, and you have a recipe for a potentially costly situation.

Accordingly, your attorneys should be geared towards quick resolution of first party matters, either via settlement or trial.
